In a decision written by Justice John Paul Stevens, an unusual five-member majority said police may search a vehicle without a warrant only when the suspect could reach for a weapon or try to destroy evidence or when it is "reasonable to believe" there is evidence in the car supporting the crime at hand. The court noted that law enforcement for years has interpreted the court's rulings on warrantless car searches to mean that officers may search the passenger compartment of a vehicle as part of a lawful arrest of a suspect. But Stevens said that was a misreading of the court's decision in New York v. Belton in 1981. Instead, most of the justices voiced concern that students could hide dangerous drugs such as crack cocaine or heroin in their clothes. The case before the court concerns a 13-year-old Arizona girl who was strip searched in a nurse's office after a school friend said the girl, Savana Redding, had brought white pills to school. The pills were extra-strength ibuprofen, which is commonly taken for headaches and cramps. Last year, a U.S. 9th Circuit Court of Appeals ruled that the strip search of Savana Redding was unreasonable and unconstitutional since the pills were ibuprofen. And the court held that the school officials who ordered the search were liable for damages. But in their comments and questions, most of the justices signaled they are inclined to overturn that decision.
FennRx Posted April 21, 2009 Posted April 21, 2009 i have always thought that the probable cause thing as it relates to a warrantless car search is bullshit. your word versus the cop's...hmmm, i wonder who will win? now if you leave a bag of coke on the passenger seat, well then you deserve what's coming to you. as for the strip seach, that is totally messed up. how can there be any question that the school was out of line?

A joint was just smoked and the roach thrown out the window. Two minutes later we were pulled over because a headlight was out. Two cops came up and obviously smelled it. The two guys in the front were taken out of the car & searched. The driver had a little bit of dope on him. So, they were both handcuffed and thrown in the back of the cruiser. For some reason, they left me in the back seat. One of the cops then searched the front of the car and found a 1/4 lb of dope under the passenger seat. Although it was just for personal use, both of my friends were chaged with possesion with the intent to sell. I wasn't charged because I was in the back seat. It was thrown out in court. In Ontario, it is illegal for police to search your vehicle based on smell or redness of the eyes.

The fact that the Supreme Court is thinking of overturning a unanimous decision by the Court of Appeals seems absolutely crazy. The school had only scant evidence that this girl had done anything wrong, and that's being generous. No thirteen-year-old kid - in this case an honor student - should be forced to "empty her bra and crotch area" (her words on the news) in front of school administrators. I usually take a dim view of students crying foul against school discipline, but in this case, it's beyond justified. The school is shooting itself in the foot: this opens the door to sexual harassment lawsuits against schools.

The car was searched for some reason. No drugs were found, but 2.5 million in cash was. They are being held until police find out where the money came from. I know they aren't on the up and up, but since when is having loads of money a crime? I'll try to find out more and post a link.

I didn't even have anything on me so I should have just denied. But yeah I live in California and medical weed is legal. But I don't think that really matters.

A couple weeks ago me and my friend were smoking at this place and kindof lost track of time so it was late. And I don't have my liscence but I could have it...anyways I thought we should park the car in a less sketchy spot so I was just moving to a different spot in the p-lot. And of course a cop pulls in right in front of my ***. So I tried to make it to my friends house down the street before he pulled us over but he got us. He was all where's the weed so we gave him our weed..our joints..our bong..our papers grinder blunt wraps. You get it we were busted. Anyways. We smooth talked him into letting us go with all of our stuff and everything! It was cool. And one of my friends got pulled over in a hotboxed car. And the cop pulls them over and goes "it smells like a marijuana oven in here" and he got away unscathed too!

Just so that you have something to look forward to, right now down here you can come to my house, break in, steal stuff for under 650 bucks and I can't say a thing about it. If I catch you and beat the **** out of you, you can sue me and I will have to pay you whatever you see fit for the inconvenience... Also, if I caught you and took you to the authorities (without cutting your nuts off) then you wouldnt have to go to jail, you would have to pay a 15 fee and then would go free to come back and kill me or whatever. Also stealing cellphones, portable computers, shoes, walets and other stuff is no longer a felony. If they robbed you on the street and they didnt do it violently (translate: you didn't resist and so didn't "make them gut you") then it's not a felony and it's not even worthy of mention... so if you want to be able to report it you have to get yourself gutted or shot at, and even the, the asshole in charge will ask you who in his right mind gets gutted or shot at over a cellphone or a laptop... in other words: you are an idiot for not valuing your life enough to give the stuff to the thief. I will continue my rant tomorrow... I'll go to sleep now...

That kind of thing would definitely not fly around here, The Principle would probably get charged with something. I remember one time in high school, a friend and I got hauled into the Principle's office because we stunk like weed and were clearly stoned and he asked us to empty our pockets. We just looked at each other were like "No thank you, we'd rather not". We knew he wasn't going to start shoving his hands down our pockets so he just ended up telling us to "Get out of his sight!" or something to that effect.

He was taken away in handcuffs with a burlap bag over his head to an undisclosed location where he was beaten, tortured and forced to watch propaganda videos and go through indoctrination and purification rituals. The Gibson Lounge never heard from him again. Not long after that a bunch of the local communist supporters from the neighborhood showed up at his place and took all of Thunders music equipment and have since posted the entire contents on Craigslist and ebay. Thudergod now works in a sugar factory and lives in substandard housing, making roughly a dollar a day.
