martinh Posted January 5, 2012 Posted January 5, 2012 Under US law, I would say that both Paypal and the buyer are in deep trouble. Although there are provisions in copyright and trademark law allowing for the seizure and destruction of counterfeit goods, my understanding is that only law enforcement agencies have the right to do this. I don't know if this happened because Canadian law has some provision requiring private entities to destroy alleged counterfeit merchandise. However even if that is so, surely it requires some sort of expert attestation that the goods are, in fact, counterfeit, not the word of a disgruntled buyer. Now, I've heard of a scam where a con artist buys a LP custom off Ebay, complains loudly that it's a fake, and then returns a fake to the seller while keeping the real instrument However this misguided policy seems like this could lead to some great scams in Canada: 1. Buy nasty Chinese Les Paul Custom 2. Buy similar Custom from E-bay 3. Complain loudly to PayPal that guitar you received is nasty Chinese counterfeit. Provide pictures and references to fake Chinese guitar trade. 4. Receive refund, smash nasty Chinese Les Paul Custom, provide photographs, and throw remains of instrument in trash. 5. Evidence is gone before anyone can start legal action, and scammer has nice LP Custom. NOTE: I'm NOT suggesting anyone try this. It is Illegal, immoral, and you will go to Hell. I'm just pointing out the possible consequences of such a ridiculous policy
alexri Posted January 6, 2012 Posted January 6, 2012 I got fu(ked over pretty bad by Ebay's "VeRo" policy. If you don't know anything about it google "ebay vero nightmare stories." They're a very unforgiving, greedy monster of a company. I hope they go down. They think they can get by, by treating people like garbage, well that will only get you so far. Karma will bite them in the a33 sooner or later. Rot in hell ebay/paypal management.

Isn't it awesome how on the internet you can present your case without any opposing or other side of the story ? Read it and move on. These types of posts (that which the original poster presented) are of absolute no value and are meant to stir emotions. Pure rubbish, IMHO of course :) Harmonics101

They just lost me as a customer with their nonsense. I mean it's the sellers that make their business model possible yet they refused to release my funds for 21 days on my last sale because I haven't done 25 or more transactions in the last 90 days. Nevermind my 100% positive rating. Combined with the constantly rising fees, I am gone. Of course, Craigslist has its own unique problems so I don't use it either. Will have to rely on various forum classifieds, I guess.

TommyK Posted January 6, 2012 Posted January 6, 2012 My son had an experience with PayPal. He had not used his PayPal in almost a year. One day checks he had written were bouncing. Turned out PayPal had charged his account for 499.99 for a satellite phone which he had no knowledge of. He quickly contacted PayPal about the fraudulent charge. They said they would investigate it, probably would take 2 - 4 weeks before he would see his money. He told them he needed to pay rent next week and he couldn't wait 2 - 4 weeks. PayPal gave him the stone wall while they investigated. My son's next step was a stroke of genius. He went to the Credit Union where he banked. He explained the situation and they bank manager said, "Your money will be back in your account tomorrow. We will hold back $499.99 of today's transfer to PayPal, then continue to hold it while they investigate." Apparently the Credit Union had a lot of customers using PayPal. A. The Credit Union had leverage with PayPal. B. The Credit Union was motivated to keep their customer (my son) happy. One other thing I learned: Never buy anything on the 'net, with or without PayPal, with your household account. Keep a separate Internet buying account with a hundred bucks in it. DO NOT allow the bank to put an automatic 'loan' on the account if it goes over drawn (Over draft protection). Only keep enough money in it to cover expected purchases. That way if your account gets 'hit', the damage is minimized and your household expense accounts are untouched. Make sure your household accounts are untouchable by electronic withdrawals, get it in writing from the bank. This is the functional equivalent of a retail store making periodic bank deposits through out the day to minimize the cash in the cash drawer to minimize risk. If you have all your household expenses paid automatically, you are just asking for trouble.

GuitarsAnn Posted January 6, 2012 Posted January 6, 2012 I have used Paypal a lot and have had no problems. I like the idea of a secured way of paying for things. I would not give anyone access to my bank accounts, though, including Paypal. One good CC should be all they need and limits the risk. Debit cards and bank account access should never be used, IMHO. I think there should be some sort of abritration regarding fraudulent sales. If they are proven to be fraudulent, then the seller should be prosecuted. If there is fraud on the part of the buyer, then they should be prosecuted. I would think more than just a scream of foul by the buyer is needed and an investigation is warranted.IMHO Nice meatloaf recipe!!! I will try it. GuitarsAnn :) :)
