Stevie Nazarenie Posted September 24, 2008 Share Posted September 24, 2008 well gibson have said mines a fake. i have asked for it in writing they said use our emails as proof. on the ebay forum and paypal say only hard copies are good proof. they could pick up the phone to gibson but thats too easy. so i guess i'm going to have be be messed around for a while. how did you get your proof for your fake epi? (including pics) Wouldn't those qualify as hard copies? Mail them to paypal. It does sound like they are trying to side step the issue....but what can you do except be persistant? Maybe Fax? Explain the situation to them and see if they can deny paypals claim for payment without hurting your credit? or...Has payment already been made and you are just trying to get your money back? jozluck Posted September 24, 2008 Share Posted September 24, 2008 1. Go to the Ebay site and REPORT IT to Security, then if your lucky, you used Pay Pal. Ebay and Pay Pal will use the E Mails. 2. You have to report it to Pay Pal and open a DISPUTE first. The seller gets some time to make arangements...so you have to wait. 3. DONT WAIT TOO LONG>>>>> thats how they get you....Ebay could care less, reguardless of the nice talk from my experence. Just too much going on for them to give one person buys a darn. Want my list of Ebay defaults: Stuck with the Joe Pass which needed all new electronics and finish, MIJ 62 reissue Strat which had the electronics switched out and neck switched, (nothing back from them, but Tammy did send two worthless pickups to replace the worthless pickups in there which were rebuilt), Scorpion parts which sent all wrong parts over 30days late-got refund but your waiting to get these things, a watch that was intentionaly broken by the seller because they did not want to send it for the bid....now they charge 28$ shipping cost. We all want a deal, but man, if it wasn't for a few things, its just not worth it sometimes..... OPEN THE DISPUTE and hopefully you used paypal.....don't wait, Pay Pal is good for the money...they make up for the BS with Ebay. Buy from big sellers who have something to lose with a bad post. If it really was a scam that money has already been transfered and withdrawn so there will be nothing in the account to return. Paypal also doesn't care if you get your money back because then they are also refunding their transaction fees and they don't want to loose out on their $10. I think it goes with out saying that I have been burned buy Paypal in the past and I detest their company. Stevie Nazarenie Posted September 24, 2008 Author Share Posted September 24, 2008 the dispute has been going for months. mostly after paypal has done nothing. now the seller is no longer registered after i contacted gibson yesterday and they got the legal department onto the seller. but i am being asked to return it to someone in the uk or no refund when it came from china. the ebay forum say to send it back is accessory to fraud. i'm going to stick with that fact too. i am not paying to send back a fake at my expense. i asked this of paypal a week ago and they said you don't have to send back fakes. it seems this is only covered by paypal upto £150 and i payed £194 too. i have my visa through paypal. i hope they haven't made this time out in any way. I think the people on the e-bay forum are quite right, and you should not send this guitar by post. It's not the actual posting of the thing that is the problem. It is the actual supplying of it. The statute is the Trade Descriptions Act 1968. Section 6 makes it an offence to..."expose goods for supply" if the goods are counterfeit. The whole statute is available online at: http://www.opsi.gov.uk/Acts/acts1968/PDF/ukpga_19680029_en.pdf Have you thought about contacting your local Citizens' Advice Bureau about this matter? Their advice is free, and they do specialize in consumer problems (they even have specialist consumer advisers). If you do trash the guitar' date=' make sure that you keep the wreckage until you've got your money back. I reckon you're going to get a [b']lot[/b] of weak sarcasm from your local coppers, when you ask them to certify that you've smashed a guitar. Some young PC is definitely going to refer to you as "Hendrix." By the way, have you seen this? Stevie Nazarenie Posted September 29, 2008 Author Share Posted September 29, 2008 interesting read. while it's a fake epi and not what i paid for it could have been a half useable guitar if i get it patched up or just to hang on my wall. i would have done the destruction if i know i'm going to get a full refund but at the end of the day i may only get £150 of the £194 i paid so £44 for a cheap copy is about right! i have asked gibson about this recommendation to destroy the guitar and what may be neccessary to be legal. it may just be the name on the headstock needs to be removed. also i asked for a letter... i hope they'll do it. if i get probs i suppose i can try visa but i won't be happy with the ebay experience. the neck is set. i am no super great luthier. If it aint too bad, I'd be tempted to go for a relatively stress-free option - find a some decent pu's and hardware for it and get a luthier to set it up - sort the frets out and that kind of stuff. It will cost some more but your quest for a legal solution may well fall flat...Ebay/Paypal will only act when its in THEIR interests..this aint their problem so they probably won't do anything. Stevie Nazarenie Posted September 30, 2008 Author Share Posted September 30, 2008 http://forums.epiphone.com/Default.aspx?g=posts&t=5167&p=3 scroll down to the pickup less alpine white les paul copy. there are some pics on page 3. i can play on anything no matter how badly setup. or at least adjust it to what i want. i have tried out some different pickups in it. it currantly has my g400 pickups in it. i will be doing lots of swapping of pickups. i just bought a vintage av1 and i love it. the pickups in my vrs100 are meant to be the same but they don't sound as good in it so i could put them in the fake. i'm planning on putting a p90 in the vrs100 when it arrives. i've also bought a scratch plate for a strat hsh so i'm going to see what sounds good where. lots of experimentation. the tuners are not too good. the pickups were microphonic and the nut was not cut right and the wood is??? it's a very thick neck... but it did have a deep sound and lots of sustain with the original pickups + lots of squeeling though. i imagine it's what you'd get for a starter guitar type budget? but i can play them and still enjoy them!
